GENERAL
1. Appointments, orders of reference, authority, membership and general provisions – See Standing Orders 4(a),(c), 100 through 107 of the Standing Orders of the Legislative Assembly (January 2009).
2. That Bas Balkissoon, Member for the Electoral District of Scarborough–Rouge River, be appointed Deputy Speaker and Chair of the Committee of the Whole House; that Ted Arnott, Member for the Electoral District of Wellington–Halton Hills, be appointed First Deputy Chair of the Committee of the Whole House; that Julia Munro, Member for the Electoral District of York–Simcoe, be appointed Second Deputy Chair of the Committee of the Whole House; and that Paul Miller, Member for the Electoral District of Hamilton East–Stoney Creek, be appointed Third Deputy Chair of the Committee of the Whole House – November 28, 2011.

GENERAL

2. Orders of reference, authority and general provisions – See Standing Orders 108 through 131 of the Standing Orders of the Legislative Assembly (January 2009).
3. The Speaker informed the House that, in accordance with Standing Order 117(c), the House Leaders have selected in rounds the Recognized Parties from which the Committee Chairs shall be drawn:- Chairs shall be drawn from the caucus of the Government for the following Committees:- Standing Committee on Finance and Economic Affairs, Standing Committee on Government Agencies, Standing Committee on General Government, Standing Committee on Justice Policy; Chairs shall be drawn from the caucus of the Official Opposition for the following Committees:- Standing Committee on Public Accounts, Standing Committee on the Legislative Assembly, Standing Committee on Social Policy; Chairs shall be drawn from the caucus of the Third Party for the following Committees:- Standing Committee on Estimates, Standing Committee on Regulations and Private Bills (Sessional Paper No. 5) (Tabled November 24, 2011) – November 28, 2011 [1st Session].
4. That, notwithstanding Standing Order 108, and pursuant to Standing Order 113, the following Standing Committees be appointed and that the membership of these committees be as follows: [See individual Committees for membership]; and
That, except for its responsibilities set out in Standing Order 111(b), the Standing Committee on the Legislative Assembly shall consider no other business prior to the completion of a study and the tabling of a report on the Standing Orders of the Legislative Assembly of Ontario; and
That, notwithstanding any Standing Order, no government Bill shall be referred to the Standing Committee on Estimates or to the Standing Committee on Public Accounts; and
That, the terms of this Motion shall terminate on the day before the first day of the 2012 Fall Meeting Period – February 23, 2012.
5. That, the following schedule for Committee meetings be established for the 40th Parliament:- The Standing Committee on Justice Policy may meet on Thursday mornings to 10:25 a.m. and Thursday afternoons following routine proceedings; The Standing Committee on Social Policy may meet on Monday and Tuesday afternoons following routine proceedings; The Standing Committee on General Government may meet on Monday and Wednesday afternoons following routine proceedings; The Standing Committee on Finance and Economic Affairs may meet on Thursday mornings to 10:25 a.m. and Thursday afternoons following routine proceedings; The Standing Committee on Estimates may meet on Tuesday mornings to 10:25 a.m. and Tuesday and Wednesday afternoons following routine proceedings; The Standing Committee on Government Agencies may meet on Tuesday mornings to 10:25 a.m.; The Standing Committee on the Legislative Assembly may meet on Wednesday afternoons to routine proceedings; The Standing Committee on Public Accounts may meet on Wednesday mornings to 10:25 a.m. and Wednesday afternoons to routine proceedings; The Standing Committee on Regulations and Private Bills may meet on Wednesday mornings to 10:25 a.m. – February 27, 2012.
6. That the Standing Committee on General Government review the Aggregate Resources Act and report to the House its observations and recommendations with respect to strengthening the Act. In developing such recommendations, the Committee's focus shall include, but not be limited to, the following areas: The Act's consultation process; How siting, operations, and rehabilitation are addressed in the Act; Best practices and new developments in the industry; Fees / Royalties; and, Aggregate resource development and protection, including conservation / recycling – March 22, 2012.
7. That Mr. Kelly Mitchell be called to appear before the Standing Committee on Public Accounts, and that the Clerk be directed to schedule him at the earliest possible time – April 19, 2012.
8. The Speaker informed the House That the following document was tabled: A copy of his Warrant, issued in accordance with the adoption of the House on April 19 of the Report of the Standing Committee on Public Accounts respecting testimony of Dr. Chris Mazza, which was delivered in person on his order by the Sergeant-at-Arms on April 20, 2012 (Sessional Paper No. 74) – April 23, 2012.
9. That when Bill 13, An Act to amend the Education Act with respect to bullying and other matters, is next called as a Government Order the Speaker shall put every question necessary to dispose of the Second Reading stage of Bill 13 without further debate or amendment and at such time Bill 13 shall be ordered referred to the Standing Committee on Social Policy (“the Committee”); and
That the vote on Second Reading may be deferred pursuant to Standing Order 28(h); and
That Bill 14, An Act to designate Bullying Awareness and Prevention Week in Schools and to provide for bullying prevention curricula, policies and administrative accountability in schools, the private members' bill sponsored by the former member from Kitchener–Waterloo be reinstated at the Standing Committee on Social Policy at the same status it was as of April 26, 2012 and that sponsorship of Bill 14 be transferred to the member from Nepean–Carleton in order to allow Bill 14 to receive public hearings simultaneously with Bill 13 and that its clauses be considered at the clause-by-clause stage of Bill 13 in accordance with the terms of this motion; and
That the Committee be authorized to meet in Toronto during its regular meeting times on Monday, May 7, Tuesday, May 8, Monday, May 14 and Tuesday, May 15, 2012 for the purpose of conducting public hearings on Bill 13 and Bill 14; and
That the Committee be authorized to meet beyond its normal meeting times on Monday, May 14, 2012 and Tuesday, May 15, 2012 for the purpose of conducting public hearings, but must adjourn on both days no later than 8:00 p.m.; and
That the Committee be authorized to sit on one day during the Constituency Week of May 21, 2012 through May 24, 2012 for the purpose of holding public hearings on Bills 13 and 14 in Ottawa, Ontario; and
That the Committee be authorized to meet in Toronto during its regular meeting times on Monday, May 28 and Tuesday, May 29, 2012 for clause-by-clause consideration of Bill 13; and
That the Committee shall be authorized to meet beyond the normal hour of adjournment for clause-by-clause consideration on Tuesday, May 29; and
That during clause-by-clause consideration of Bill 13, the Committee shall dedicate Monday, May 28 to considering which, if any, elements or clauses of Bill 14 should be incorporated into Bill 13, and that any remaining time on May 28 and all of May 29 shall be dedicated only to dealing with remaining clause-by-clause amendments to Bill 13; and
That the Committee be authorized during clause-by-clause consideration to incorporate such provisions of Bill 14 into Bill 13, as the Committee deems appropriate.
That the deadline for filing amendments to Bill 13 with the Clerk of the Committee shall be 5:00 p.m. on Thursday, May 24, 2012. At 5:00 p.m. on May 29, 2012, those amendments which have not yet been moved shall be deemed to have been moved, and the Chair of the Committee shall interrupt the proceedings and shall, without further debate or amendment, put every question necessary to dispose of all remaining sections of Bill 13 and any amendments thereto. Any division required shall be deferred until all remaining questions have been put and taken in succession with one 20-minute waiting period allowed pursuant to Standing Order 129(a); and
That, despite the deadline for filing amendments, amendments that arise during discussions at Committee on May 28 incorporating Bill 14 into Bill 13 may be introduced during the course of clause-by-clause hearings on that day, provided the amendment relates to the scope and principle of Bill 14.
That upon completion of clause-by-clause of Bill 13, the Committee shall refer Bill 13, as amended, only back to the House to commence Third Reading debate on Bill 13, as amended; and
That the Committee shall report Bill 13 to the House no later than Wednesday, May 30, 2012. In the event that the Committee fails to report Bill 13 on that day, Bill 13, as amended, shall be deemed to be passed by the Committee and shall be deemed to be reported to and received by the House; and
That upon receiving the report of the Committee, the Speaker shall put the question for adoption of the report forthwith, and at such time Bill 13, as amended, shall be ordered for Third Reading, which order may be called on that same day; and
That, when the Order for Third Reading of Bill 13, as amended, is called, four hours shall be allotted to the Third Reading stage of Bill 13, as amended, apportioned equally among the recognized parties. At the end of this time, the Speaker shall interrupt the proceedings and shall put every question necessary to dispose of this stage of Bill 13, as amended, without further debate or amendment; and
That the vote on Third Reading may be deferred pursuant to Standing Order 28(h); and
That in the case of any division relating to any proceedings on Bill 13, as amended the division bell shall be limited to 5 minutes – May 3, 2012.
10. That notwithstanding any Standing Order or special Order of the House, there be a timetable applied to the consideration of certain business of the House as follows:
(A) Private Members’ Public Bills
No later than Thursday, November 1, 2012 the House Leaders of the 3 recognized parties shall by agreement, indicated in writing to the Clerk of the House, select up to 9 Private Members’ Public Bills, 3 per party, for consideration in accordance with the following process:
If any of the selected bills is currently Ordered for Third Reading, the Order for Third Reading shall be discharged and the bill shall be recommitted to the same standing committee to which it was originally referred, and the respective committee shall meet at the call of the chair for up to 90 minutes of clause-by-clause consideration of the bill; and
Any other of the selected bills, after receiving Second Reading during Private Members’ Public Business, shall be referred to a standing committee in the normal way, and the respective committee shall meet at the call of the chair for up to one day of public hearings and up to one day of clause-by-clause consideration of the bill, on dates and at times as agreed to by the committee; and
Any bill recommitted or referred to a standing committee under this section shall be reported back to the House no later than Thursday, November 29, 2012. In the event any of the selected bills are not reported by that day, such bills shall be deemed to be passed by the Committee and shall be deemed to be reported to and received by the House and at such time the bills shall be Ordered for Third Reading; and
The Order for Third Reading of one of the indicated bills standing in the name of a member of the Official Opposition and one of the indicated bills standing in the name of a member of the Third Party shall be called no later than Wednesday, June 13, 2012; and
The Orders for Third Reading of two of the indicated bills standing in the names of members of the Official Opposition and two of the indicated bills standing in the names of members of the Third Party shall be called no later than Wednesday, December 12, 2012; and
When the Order for Third Reading of any of the selected bills is called, 60 minutes shall be allotted to the Third Reading stage of the Bill, apportioned equally among the recognized parties. At the end of this time, the Speaker shall interrupt the proceedings and shall put every question necessary to dispose of this stage of the Bill without further debate or amendment; and
In the event of prorogation, any of the selected bills remaining on the Orders and Notices Paper at prorogation shall be continued and placed on the Orders and Notices Paper of the second sessional day of the Second Session of the 40th Parliament at the same stage of progress as at prorogation, and the timelines in this section shall continue to apply.
(B) Committees
The following committees are authorized to meet during the 2012 Summer Adjournment:
Standing Committee on Public Accounts: for the purpose of considering the Special Report of the Auditor General on Ornge Air Ambulance and related services, on June 26, July 18 and July 31, and August 1 and August 2. Any of these dates are transferrable to another date by agreement of the Sub-committee on Committee Business, and the Committee may meet on additional dates as agreed to in writing by the House Leaders of the recognized parties and filed with the Clerk of the House; and
The Committee is also authorized to attend the 2012 Annual Conference of the Canadian Council of Public Accounts Committees.
Standing Committee on General Government: for the purpose of its review of the Aggregate Resources Act, on up to 4 days during June/July, on dates and in locations in Ontario established by the Committee.
Standing Committee on Finance and Economic Affairs: the Committee shall be assigned the review of the Auto Insurance Industry, currently being conducted by the Standing Committee on General Government pursuant to Standing Order 111, and that all evidence and papers relating to this review be transferred to the Standing Committee on Finance and Economic Affairs; and
The Committee is authorized to meet during the Summer Adjournment for the purpose of this review on up to 4 days during June/July, on dates and in locations in Ontario established by the Committee.
Standing Committee on Estimates: for the purpose of considering Estimates, on up to 4 days during June/July, on dates established by the Committee.
Standing Committee on Government Agencies: for the purpose of reviewing the operations of the Liquor Control Board of Ontario, on up to two days in June, and of the Workplace Safety and Insurance Board, on up to two days in July, on dates and in locations in Ontario established by the Committee.
Standing Committee on the Legislative Assembly: for the purpose of its review of the Standing Orders, on up to 4 days during June/July, on dates established by the Committee; and that for the purpose of its review of the Standing Orders the Committee is further authorized to adjourn from place to place as unanimously agreed to by its Sub-committee on Committee Business; and
The Committee is also authorized to attend the 2012 Annual Meeting of the National Conference of State Legislatures.
(C) Bill 55, An Act to implement Budget measures and to enact and amend various Acts
When Bill 55 is next called as a Government Order the Speaker shall put every question necessary to dispose of the Second Reading stage of the Bill without further debate or amendment and at such time the Bill shall be Ordered referred to the Standing Committee on Finance and Economic Affairs; and
The Committee is authorized to meet for the purpose of public hearings on the Bill in accordance with the following schedule:
June 6 – 9:00 a.m. to 10:25 a.m. and 1:00 p.m. to 6:00 p.m.
June 7 – 9:00 a.m. to 10:25 a.m. and 3:00 p.m. to 9:00 p.m.
June 8 – 1:00 p.m. to 9:00 p.m.
June 11 – 9:00 a.m. to 10:25 a.m. and 1:00 p.m. to 6:00 p.m.
June 12 – 9:00 a.m. to 12:00 noon
The deadline for filing amendments to the Bill with the Clerk of the Committee shall be 6:00 p.m. on Tuesday, June 12, 2012; and
The Committee is authorized to meet for the purpose of clause-by-clause consideration of the Bill in accordance with the following schedule:
June 14 – 9:00 a.m. to noon and 1:00 p.m. to 5:00 p.m.
June 18 – 9:00 a.m. to noon and 1:00 p.m. to 5:00 p.m.
June 19 – 9:00 a.m. to noon and 1:00 p.m. to 5:00 p.m.
At 2:00 p.m. on Tuesday, June 19, those amendments which have not yet been moved shall be deemed to have been moved, and the Chair of the Committee shall interrupt the proceedings and shall, without further debate or amendment, put every question necessary to dispose of all remaining sections of the Bill and any amendments thereto. Any division required shall be deferred until all remaining questions have been put and taken in succession with one 20-minute waiting period allowed pursuant to Standing Order 129(a); and
The Committee is authorized to meet beyond its hour of adjournment for clause-by-clause consideration on June 19, 2012.
The report of the Committee on the Bill shall be deemed to have been made, and shall be deemed to be received and adopted when “Reports by Committees” is called by the Speaker on June 20, and at such time the Bill shall be Ordered for Third Reading, which Order shall then immediately be called; and
Two hours shall be allotted to the Third Reading stage of the Bill, apportioned equally among the recognized parties. At the end of this time, the Speaker shall interrupt the proceedings and shall put every question necessary to dispose of this stage of the Bill without further debate or amendment; and
If a recorded vote is required on the motion for Third Reading of the Bill, the vote shall be deferred until “Deferred Votes”.
In the case of any division relating to any proceedings on the Bill, the division bell shall be limited to 5 minutes.
(D) Bill 19, An Act to amend the Residential Tenancies Act, 2006 in respect of the rent increase guideline
When Bill 19 is next called as a Government Order the Speaker shall put every question necessary to dispose of the Second Reading stage of the Bill without further debate or amendment and at such time the Bill shall be Ordered referred to the Standing Committee on Justice Policy; and
The Committee is authorized to meet for the purpose of public hearings on the Bill during its regular meeting times on Thursday, June 7; and
The deadline for filing amendments to the Bill with the Clerk of the Committee shall be 2:00 p.m. on Friday, June 8, 2012; and
The Committee is authorized to meet for the purpose of clause-by-clause consideration of the Bill following Routine Proceedings on Monday, June 11; and
The Committee shall report the Bill to the House not later than Tuesday, June 12. In the event that the Committee fails to report the Bill on that day, the Bill shall be deemed to be passed by the Committee and shall be deemed to be reported to and received by the House; and
Upon receiving the report of the Standing Committee on Justice Policy, the Speaker shall put the question for adoption of the report forthwith, and at such time the Bill shall be Ordered for Third Reading, which Order may be called on that same day; and
When the Order for Third Reading of the Bill is called, 2 hours shall be allotted to the Third Reading stage of the Bill, apportioned equally among the recognized parties. At the end of this time, the Speaker shall interrupt the proceedings and shall put every question necessary to dispose of this stage of the Bill without further debate or amendment; and
The vote on Third Reading may be deferred pursuant to Standing Order 28(h); and
In the case of any division relating to any proceedings on the Bill, the division bell shall be limited to 5 minutes.
(E) Parliamentary Calendar
Notwithstanding Standing Order 6(a)(i), the House shall continue to meet from Monday, June 11 to Thursday, June 14, 2012; and
On June 14, 2012 the House shall adjourn following Deferred Votes and it shall stand adjourned until Wednesday, June 20, 2012; and
The order of business on June 20 shall be as follows:

Introduction of Bills – for the purpose of permitting the introduction and First Reading of a Government Bill providing for the following:
An amendment to subsection 29(2) of the Taxation Act, 2007 to provide that a corporation’s basic rate of tax for a taxation year ending after June 30, 2012 is 11.5 per cent; and
An amendment to the Taxation Act, 2007 to increase to 13.16 per cent the tax rate for individuals on taxable income over $500,000 and to make such other technical amendments to that Act as may be appropriate to implement this tax rate, including consequential amendments to other tax rates under that Act.
And that the Orders for Second and Third Reading of this Bill shall immediately be called consecutively; and
The Speaker shall put the question on the motions for Second and Third Reading of the Bill immediately, without debate or amendment, no deferral of either vote being permitted; and
In the case of any division relating to any proceedings on the Bill, the division bell shall be limited to 5 minutes.
*Except that:
In the event that the required amendments are not made to Bill 55, the first order of business at Introduction of Bills and immediately following Deferred Votes, shall be the introduction of a Government Bill to amend the Taxpayer Protection Act, 1999 in such a way as to permit the Taxation Act, 2007 to be amended to increase the tax rate for individuals with a taxable income over $500,000;
And that the Orders for Second and Third Reading of this Bill shall immediately be called; and
The Speaker shall put the question on the motions for Second and Third Reading of the Bill immediately, without debate or amendment, no deferral of the vote being permitted; and

(F) Board of Internal Economy
The passage of this motion shall constitute an Order to the Attorney General to introduce a bill, no later than the third day the House meets in the Fall Sessional Period, to amend Section 87 of the Legislative Assembly Act respecting the Board of Internal Economy, as follows:
That the Commissioners appointed to the Board of Internal Economy shall be:
(A) the Speaker (Chair (non-voting))
(B) one member of the Executive Council
(C) one member from the caucus of each recognized opposition party
(D) one or more members of the government caucus, as necessary, to provide that the total number of Commissioners appointed under clause (B) and by the government caucus equals the number of Commissioners appointed under clause (C)
And that the Orders for Second and Third Reading of the Bill shall be called consecutively at the outset of morning Orders of the Day on the first Tuesday following introduction of the Bill; and
The Speaker shall put the question on the motions for Second and Third Reading of the Bill immediately, without debate or amendment; and
In the event of prorogation, the Order in this section to the Attorney General shall endure and the Bill shall be introduced no later than the third sessional day of the Second Session of the 40th Parliament, and the other timelines in this section shall continue to apply – May 31, 2012.
11. That in “Section B – Committees” of the motion passed by the House on May 31, 2012, in the paragraph respecting the Standing Committee on Public Accounts, the phrase “agreement of the Sub-Committee on Committee Business” is interpreted to mean unanimous agreement of the Sub-Committee on Committee Business; and
That in “Section C – Bill 55, An Act to implement Budget measures and to enact and amend various Acts”, the dates and times established for public hearings and for clause-by-clause be adjusted as follows:

13. The Speaker informed the House That pursuant to “Section A” of the Order of the House passed on May 31, 2012, the House Leaders have indicated in writing to the Clerk of the House that the following two private members’ public bills have been selected:
Bill 8, An Act respecting an underground infrastructure notification system for Ontario; and
Bill 33, An Act to amend the Human Rights Code with respect to gender identity and gender expression – June 11, 2012.
14. That notwithstanding “Section A – Private Members’ Public Bills” of the Order passed by the House on May 31, 2012, the requirement that the Order for Third Reading of Bill 8, An Act respecting an underground infrastructure notification system for Ontario be discharged, and that the Bill be recommitted to the Standing Committee on General Government, be waived, and that Bill 8 remain ordered for Third Reading; and

That the Committee shall report the Bill to the House no later than Monday, September 10, 2012. In the event that the Committee fails to report the Bill on that day, the Bill shall be deemed to be passed by the Committee and shall be deemed to be reported to and received by the House; and
That, upon receiving the report of the Standing Committee on Social Policy, the Speaker shall put the question for adoption of the report forthwith, and at such time the Bill shall be Ordered for Third Reading; and
That, on the day the Order for Third Reading of the Bill is called, two hours shall be allotted to the Third Reading stage of the Bill, apportioned equally among the recognized parties. At the end of this time, the Speaker shall interrupt the proceedings and shall put every question necessary to dispose of this stage of the Bill without further debate or amendment; and
That the vote on Third Reading may be deferred pursuant to Standing Order 28(h); and
That, in the case of any division relating to any proceedings on the Bill, the division bell shall be limited to 5 minutes – September 5, 2012.
16. That this House directs the Minister of Energy and the Ontario Power Authority to table immediately with the Clerk of the House all remaining documents ordered by the Standing Committee on Estimates on May 16, 2012; and
That the matter of the Speaker's finding of a prima facie case of privilege, with respect to the production of documents by the Minister of Energy and the Ontario Power Authority to the Standing Committee on Estimates, be referred to the Standing Committee on Finance and Economic Affairs, which is hereby re-constituted as it existed on September 9, 2012; and
That the Committee shall be authorized to meet at the call of the Chair, and shall report back its findings and recommendations no later than November 19, 2012 – October 2, 2012.
